Crime: Thimphu district court’s bench V sentenced a teacher of a private school in Thimphu to 11 years in prison for rape of a 16-year-old girl.
The defendant, Hari Bhakta Sharma, was found guilty of having sexual relationship with a student of the school.
The court, in its verdict stated that offence of such kind calls for deterrent sentencing, as the offender is a teacher and the victim a student. “The victim is a minor and the defendant had taken advantage of his position and influence as a teacher and exploited the victim.”
The verdict also stated that the teacher had committed the crime several times. “The law must not allow innocent lives to be defiled, traumatised, and ruined and families stigmatised.”
The office of the attorney general charged the defendant for rape of child above 12 years and the victim confessed to the police and to the court that she and the teacher were in sexual relationship since 2012.
The verdict also stated that the defendant had also given contraceptive pills, I-Pill, to the girl. An empty packet of I-Pill was seized from the victim.
It also stated that besides the medical report and the defendant and victim’s confession to police, the letters exchanged between the defendant and the victim suggested that they had sexual relationship. “The text messages exchanged between them conclusively prove that the two had sexual relationship.”
“The statements submitted to the court by the victim prove that the victim was lured by the teacher to having sexual intercourse,” the verdict stated.
Meanwhile, the court also ordered the teacher to pay a compensation of Nu 90,000 to the victim.
